Legal and Medical Perspectives on the "Partial-Birth" Abortion Ban

Join Professor Stewart Jay and Dr. Sarah Prager in a discussion of the law and medicine involved in the 2003 federal "Partial-Birth" Abortion Ban Act. In 2000, the United States Supreme Court struck down as unconstitutional a similar Nebraska statute for lack of an exception for the health of the mother (Stenberg v. Carhart). The federal statute has been held unconstitutional in the Second and Ninth Circuit Courts of Appeals and is now being challenged on the same grounds. Oral arguments are scheduled before the Supreme Court on November 8 (Gonzales v. Carhart). The program will also address the various medical procedures—including what some refer to as “partial-birth” abortion—and when they are indicated.
